Explaining Crime
Causes of crime are arguably criminologyââ¬â¢s most important and largest research topic. In this process of research, criminologists and academics have used numerous theories in attempts to explain how and why people resort to crime (Ellis, Beaver, Wright, 2009). The purpose of this paper is to examine a case study first with the use of strain theories (ST), followed by social learning theory (SLT). The first section will involve a summary of the case of R v Mark Andrew HUGHES (2009) NSWDC 404 involving an outline of the offenderââ¬â¢s personal life, of his crimes, and his punishment handed down by the New South Wales District Court. It is important to outline these facts in order to refer to them and appropriately analyse them. The following section will use strain theories to analyse factors and causes that lead the offender to commit his crimes. Anomie and strain theory will be used here with respect to Mertonââ¬â¢s concept of ââ¬Å"retreatismâ⬠(Merton, in Alder, Laufer, 1995), as well as Agnewââ¬â¢s general strain theory (GST) as it accounts for individual and emotional strain derived from negative relationships (Agnew, 1992). These will be the primary theories used for analysis in this paper as they are most relevant. The final section will involve the application of SLT. Drawing from the case of R v Mark Andrew HUGHES (2009) NSWDC 404, the offender is a forty seven year old man named Mark Andrew Hughes and will be referred to as Mr Hughes for the duration of this paper. Mr Hughes childhood involved a significant degree of negative stimuli. For example, Mr Hughes experienced rejection through the failed relationship of his mother and father at a very young age, resulting in the complete absence of his biological father. Mr Hughes was then subjected to his motherââ¬â¢s new marriage and relationship with a man who was to become his stepfather. This relationship became volatile and involved alcohol abuse and violence, resulting also in separation and divorce. In addition, Mr Hughes was subjected to his motherââ¬â¢s battled with some mental health issues, and problems with the abuse of prescription medicine. Mr Hughes adult relationships somewhat reflect his mothers. He married two times of which both resulted in divorce. Importantly, the first marriage was in 1991 and created three children, of which one tragically died at seven months of age. He is currently is having virtually no contact with the other two who are now teenagers. Mr Hughes notes his second marriage (1996-2005) was extremely important to him, however collapsed due to his relationship with drugs. This marriage created two children whom he has contact with every Sunday, however his current circumstances (in custody) means this is via telephone. Apart from the minimal contact Mr Hughes has with his two sons, he has been cut off from his family. It is also acknowledged that Mr Hughes had been seeing a counsellor however stopped just prior to his crimes due to the effects of his drug addiction at the time. Drugs have been a big part of Mr Hughes life from a young age. He began using cannabis at age twelve, and his first experience with heroin was age fifteen, which resulted in addictions and long periods of residential treatment. It has been reported that in times of personal upheaval, Mr Hughes is incapable of controlling his desire to resort to drugs (substance abuse) in order to escape. In fact, in recent years Mr Hughes drug addiction has involved speed and ice to such an extent that he needed to remain high (drug-affected) in order to avoid the pain of ââ¬Å"coming downâ⬠, which was a daily habit that cost over $400 a day. It could be said that as a result of Mr Hughes early life experiences, gaining an education was a struggle, and has been limited. For instance he finished his schooling half way through secondary education, resulting in several unskilled jobs however, shortly prior to a breakdown in his second marriage, and his criminal conduct, he held a job in a recycling factory for almost fourteen years. It should be noted that the court points out the findings from a well-known clinical forensic psychologist called W John Taylor, who states that based on Mr Hughes history, he felt he had a conduct disorder in his early teenage years, confirms he is clearly battling with drug abuse disorders, and is currently suffering with depression. However he feels that Mr Hughes is genuine in his desire to overcome his addiction with drugs, and with the right support, he has a chance at reforming his behaviour and addictions. This brings us to the second issue to be outlined, that is Mr Hughes crimes. Aside from a charge of break and enter as a child, another charge regarding sexual relations with a juvenile when he himself was a juvenile, and at the age of twenty-two, convictions for false pretences, theft and drug use, Mr Hughes has managed to remain crime free regardless of his drug addictions. Also, until the most recent crimes, Mr Hughes has never served a prison term. Thus in view of these facts, the court regards this as an insignificant criminal record considering Mr Hughes current age. During the months of September to the end of November 2008 Mr Hughes resurfaces with six serious criminal offences, mostly involving break enter and steal of which was from a business, a warehouse, a workshop and two homes. Two of these offences involved criminal acts that incurred separate charges, which were stealing a car from one of the homes he entered, and also damaging property. Importantly one of the six offences was an aggravated break enter and steal from a home as one of the owners (husband) came home and surprised Mr Hughes while he was inside stealing. Mr Hughes responded with aggressive behaviour threatening him with what has been described as wire cutter, eventually forcing the man on a bed and telling him to stay there and he would not harm him. The man warned Mr Hughes that his wife was due home and hoped this would scare Mr Hughes off, however it resulted in Mr Hughes tying up the victimââ¬â¢s hands, and gagging his mouth for a short period of time while he continued to steal and ransack the home. It was mentioned that Mr Hughes did not cause any physical harm, however the crime is regarded as very serious. Finally, the court came to the overall sentence for his crimes of eight years and five months, with a non-parole period of five years and five months. The sentencing process considers a range of factors which will be discussed later. Agnewââ¬â¢s (1992) GST proposes that crime is committed as a result of pressure or strain that is derived from negative relationships and subsequent life experiences or events through those relationships. These relationships include three types of strain that involve situations where a person has taken away something valuable from another, ruined anotherââ¬â¢s opportunities to achieve a valued goal/s, or the infliction of offensive and unwanted stimuli (Bernard, Snipes, Gerould, 2010). The consequences of being subjected to strains of this nature, is the generation of various negative emotions within the person like depression, fear, anger, frustration, disappointment, and anxiety. Thus, depending on an individualââ¬â¢s characteristics and environment, these negative emotions can lead them to commit crime (Agnew, 2006). The way in which a person responds to this strain and subsequent negative emotion, is to either accept their current situation with a positive outlook, which usually involves the individual having a good support network; or turning to delinquent behaviour and the use of drugs to avoid negative emotions (Agnew, 2006; Bernard, Snipes, Gerould, 2010). From this we can already begin to see some of the aspects of GST in the case of Mr Hughes. For example, referring back to Mr Hughes personal details, Agnew would argue that because this manââ¬â¢s troubles started as a child through the loss of a relationship with his biological father, the introduction of a new father who presented negative stimuli and was ââ¬Å"imposed/not wantedâ⬠, and he was unable to remove himself from this situation or relationship due to his age, he was therefore subjected to the effects of emotional strain. In addition to this, the most significant person in his life (mother) was also presenting negative stimuli by self-medicating and engaging in volatile arguments with the stepfather. According to GST, as a child/adolescent, Mr Hughes would have been suffering with feelings like fear, anger, and disappointment, and so taking drugs was his way to directly cope/manage these emotions and interpersonal problems (Agnew, 2006). The fact that Mr Hughes was very young when he began to take drugs, as well as dropping out of school early, and committing some forms of crime, is evidence of the explained process of Agnewââ¬â¢s concepts in GST, and in fact were primarily used to explain delinquency and drug use in adolescents (Bernard, Snipes, Gerould, 2010, p. 64). Additionally, before Mr Hughes committed these most recent crimes, he has in many ways re-experienced these issues in his adult relationships. For example, the tragic loss of his first born son, the loss of his contact with his daughters and wife from the first marriage, are all examples of something valuable being removed from his life. This then occurred again in the next marriage, which Mr Hughes had stated w as very important to him, and a very big loss. Social Learning theory can also help to explain this repeated experience of Mr Hughes and will be discussed later. There are two other explanations through the use of strain theory that can help to explain why Mr Hughes lived most of his life crime free, in spite of his drug habit, before committing his most recent crimes. Firstly Agnew developed another concept within GST in the form of ââ¬Å"storylinesâ⬠which operate at a time-based level and can help to draw connections from past events to explain current issues or ââ¬Ësituation cuesââ¬â¢ (see Agnew, 2006b). Using this concept it could be said that Mr Hughes most recent crimes are a result of his desperate need for money to support his sever drug habit that is primarily a result of coping with his emotions that stem back to childhood. The second concept is derived from Mertonââ¬â¢s (1968) idea of anomie, where by societyââ¬â¢s expectations and emphasis is strongly attached to the idea of always striving to achieve monetary success, which is generally proven through the accumulation of things like houses, cars, private schooling and general wealth. However Merton argues that opportunities to achieve this success are not evenly distributed, and it is usually the lower class citizens that struggle to achieve the final goal (Merton, 1968). Never the less, each individual is expected to continue to try for their own self-respect and value (Merton, in Alder, Laufer, 1995). Merton offers four ways in which people may respond to their ability to achieve wealth, or not, through institutionalized means (see Bernard, Snipes, Gerould, 2010, p157). The most relevant of these responses with regard to Mr Hughes would be ââ¬Ëretreatismââ¬â¢. Rendering this concept, aside from long term drug use, the fact that Mr Hughes lead most of his adult life up until this point, as a law abiding citizen, and held his job for fourteen years, attempted to have a family on two occasions, and attended counselling in an attempt to rectify his personal issues and better himself, are all signs that he strived to achieve the expected societal goals and aspirations to the best of his ability within his available means. That is with limited education, no acquired skills, and limited social skills. From this, it would be argued that Mr Hughes has come to the realisation that he has once again lost his battle with drugs, and as a result failed another marriage, losing contact with his children a second time, then losing his long term job, finding himself without any family support of any kind, and thus believing, then accepting that he will never actually achieve anything. In his response to his battle to achieve, he has become a classic ââ¬Å"retreatistâ⬠, as the strain became too much to bear, thus becoming deeply engrossed in his addiction with ice to such an extent that he had to steel to fund his addiction (Merton, 1968). The underlying societal values and importance of accumulating wealth are heard in the various comments of Judge Cogswell in response to Mr Hughes crimes, and in determining sentencing (see R v Mark Andrew HUGHES [2009] NSWDC 404). One example can be seen in this comment: ââ¬Å"Once again, one can imagine the inconvenience and distress which the theft of computer and mobile phones must have had on the managers of that businessâ⬠. These comments are not just due to the loss of the physicality of the objects themselves, but also their use in the business, as they would be an important aspect in facilitating the institutional means of achieving further success. Also in Mr Hughes most serious crime, the comments again refer to the victimââ¬â¢s home being used to commit crime. For instance it was stated ââ¬Å"This must have been an extraordinarily terrifying experience for the clergyman, whose home was used to commit this crime by Mr Hughesâ⬠. This again clearly shows the importance, respect and value placed on achieved goods. These concepts of anomie and strain theory with regard to good societal goals and values are also considered and noted by the court with regard to Mr Hughes himself. For example a considerable amount of time was taken from Mr Hughes time to be served in prison to acknowledge the good in his values that was observed in the way of his remorse for his crimes, and quick pleas of guilt to all of his charges. It was stated ââ¬Å"this has a significant impact on the administration of justice in this Stateâ⬠. And because he had never served time in prison before this could be regarded as special circumstances that enabled the adjustment of the ratio between the non-parole and parole period. However it was surprising that considering how in line a lot of the court responses were with the concepts found in strain theories, that one method in which could be used to help people like Mr Hughes, and that was recommended by the court appointed psychologist mentioned earlier, was later considered as un-important by Judge Cogswell. Mr Taylor had stated that in order for Mr Hughes to have a chance at rebuilding his life, his lack of social and emotional support must be considered, and believed that his program called ââ¬Å"Ex-Inmate Programâ⬠could help with many of his issues. Mr Taylorââ¬â¢s ideas and concerns are in line with methods found in strain theories that would help to reduce the burden of strain (Bournard, Snipes, Gerould, 2010, p169) in the lives of people like Mr Hughes. Social learning Theory (SLT) compliments strain theory but most importantly can help to explain some aspects in this case that strain theory cannot. Firstly it can be argued through SLT that much of Mr Hughes negative behaviour has been learned through observing his mother and stepfatherââ¬â¢s abusive relationship, nd his motherââ¬â¢s negative coping strategies as a result of them (Bandura, 1977). Refer back to the life history and crimes of Mr Hughes, the concept of learned behaviour may explain some of the vandalism and aggressive behaviour to the victim in Mr Hughes crimes that strain theories has not. Specifically, the concept of ââ¬Ëdifferential associationsââ¬â¢ in SLT would suggest that Mr Hughes has gone through an observational process over the course o f his young life that has equipped him with the skills to behave in the way he has (Akers, 1994). That he has been isolated from more pro-social behaviour, and therefore acquired various negative attitudes motives and rationalisations for his actions (Bernard, Snipes, Gerould, 2010). This can also help to explain the similar relationship behaviour and coping strategies that Mr Hughes had to his mother. Furthermore, Burgess and Akers (1966) developed the concept of differential reinforcement, which argue that individuals engage in behaviour in ways that will positively reward them and that they can identify with from observing others. Thus it can also be argued that Mr Hughes engaged in the type of criminal behaviour that he did to reward himself with goods and money that will fund/ reward him again with drugs, which then rewards him by removing not just his emotional pain, but the painful withdrawal symptoms he acknowledged he suffered at the time of these crimes. To combine both SLT and strain theories, Mr Hughes has in a sense experienced twofold the conditions to lead him to crime and negative coping strategies. For example SLT would argues Mr Hughes observed how to manage negative emotions long before he could fully experience or understand his own, through the observation of his motherââ¬â¢s benefits from self-medicating. Thus when he became overwhelmed with strain from his negative life experiences that are explained in the prior section through strain theories, he already had in place the learned methods/behaviour of relieving his emotional strain, which would be explained by Akers (1985) concept of ââ¬Ëdifferential associationsââ¬â¢. Thus the process of ââ¬Ëretreatingââ¬â¢ discussed previously in ST, became an easier process as he has mimicked or put into action his own interpreted version of coping with the use of drugs. However, unfortunately neither of these theories account for mental health or conduct disorder, both of which Mr Hughes was diagnosed with, and are significantly related to negative home environments, delinquency and substance abuse in adolescent (Linskey, Fergusson, 1995; Hinshaw, Lee, 2003). In conclusion, SLT and ST can help to understand most of the complex issues that lead to the criminal actions of MR Hughes. It is clear that both observing and experiencing negative stimuli has consumed Mr Hughes with various negative emotions that resulted in strain. It is not hard to understand from these theories how and why Mr Hughes became so addicted to drugs and struggled to manage his relationships effectively as a result of these factors. However what is not accounted for in these theories with regard to his behaviour and crimes, are the influences of his diagnosed conduct disorder he had as an adolescent or his current state of depression.

Hewlett Packard Swot Analysis Essay
The Hewlett-Packard and Compaq merger decision case study provided many points necessary in the understanding of why these two companies would undergo a risky business venture. Compaq was a company that began successfully with record setting financial statements, but in an attempt to expand its market, threatened company stability. With the acquisition of Tandem Computer and Digital Equipment Corporation, Compaq experienced decreased revenues resulting in their inability to fully recover. In a competitive information technology market, HP was one of the industry leaders. Due to a failure to be proactive to market changes, HP grew stagnant and looked to reinvent company strategies through newly appointed President/CEO Carly Fiorina. Competitive advantages for both HP and Compaq included imaging and printing segment and high performance PC technology respectively. Managementââ¬â¢s reasons for the merger included their assumption that together, HP and Compaq would be able to replicate and overtake competitors. Oppositions to the merger included a decrease in shareholder interests, a reduction of focus for company core competencies, and an unprofitable future. Several financial advisors and industry analysts were in agreement that the proposed merger would not be in the best interests of either company. Despite the uncertainties, information gathered and forecasts projected were in favor of the merger, which resulted in shareholder approval and the merger of Hewlett-Packard and Compaq Computer. SWOT Analysis In researching Hewlett-Packardââ¬â¢s present-day company position, a strengths, weaknesses, opportunities, and threats (SWOT) analysis was conducted. Strengths found include HPââ¬â¢s strong market position internationally and on the domestic end, a successful growth throughout large acquisitions, and a considerable brand value. HP currently has a 28.6% market share in the United States of America while internationally they stand at 17.7%. As the current number one leader in PC sales, HP has a solid market position. Although the strengths are allowing HP to maintain market position, there are also weaknesses present in all companies. Compared to other companies in the same industry, Hewlett-Packard lacks significant software product and management consulting services. As a result, Hewlett-Packardââ¬â¢s weakness is its weak market segment integration. HP is able to answer consumer demand when it comes to PC technology and imaging and printing software, but they fall short in t he software product creation and consulting services to combine with their successful departments of PC technology and imaging and printing services. As Hewlett-Packard continues to grow and seek an increase in market position, opportunities surface. A spin-off of the PC technology business, entering the cloud computing market, and expanding imaging and printing solutions portfolio are opportunities HP has going forward. In placing more emphasis on the PC technology aspect of the company, HP may find that this venture will become as profitable as the imaging and printing department in the long-run. With the announcement of this spin-off, their share of US PC shipment increased from 25.4% to 28.9%. This positive reaction from consumers is an early indicator of possible success as a result of placing resources to build up the PC technology department. Cloud computing is a fairly new concept in which resources and software are delivered through a network, mainly over the Internet. As this is market quickly growing in demand, HPââ¬â¢s introduction of HP Cloud Assure is a great opportunity for future prosperity. With success comes o pportunities of threats, and Hewlett-Packard is no exception. With projected decrease in information technology (IT) in the near future, an increase in demand for non PC devices, and competitors with more diversified portfolios, HPââ¬â¢s threats are numerous. Industry analysts have projected a decrease of IT in upcoming quarters which will decrease HPââ¬â¢s profitability. HP has already witnessed a decrease in consumer spending during last quarterââ¬â¢s back-to-school spending. If analyst projections prove to be true, changes will quickly need to be made. As more and more consumers are entering the non PC device era, HP is losing a segment of the market with their inability to provide products for this demand. HPââ¬â¢s more diversified competitors such as Dell and Samsung are able to easily capture the demand for these tablets. Future of the Company Through the case study, present-day SWOT analysis, and outside research conducted on Hewlett-Packard, the group has concluded that the company will remain constant, but unless strategies are implemented to answer more consumer demands, they may lose market share. New CEO Meg Whitman has a technology visionary that will shift HPââ¬â¢s focus to answering consumer demands. Her leadership capabilities and projections for company future are a desirable mix for a company to achieve sustainable future relevance. With the implementation of HP Cloud Assure, a new venture capitalizing on the growing consumer interest of cloud computing, HP is already adapting to answering the demands of consumers. As long as the company continues to anticipate and provide the products and services desired, sustainability will be maintained. Questions 1. What are the strategic challenges that HP is facing? Strategic challenges: Cost- reduction initiatives that included ââ¬Å"difficult but necessary voluntary- severance programsâ⬠and manufacturing consolidations. ââ¬Å"Unacceptably high expense growthâ⬠contributed to a decline in earnings from operations and net earnings. HP had a weak macroeconomic environment and competitive price pressures that led to slumping sales. Management was unable to keep pace of the changing market conditions which were a key contributor. HP management failed to follow Dellââ¬â¢s lead in adopting a low- cost, Internet based direct sales channel to offset its reliance on the retail channel. * Accelerating growth in existing businesses * Streamlining the existing decentralized operating model to fuel growth opportunities * Implementing a ââ¬Å"total customer experienceâ⬠approach * Taking advantage of HPââ¬â¢s strong balance sheet and cash generation capability to fund new growth initiatives * Leveraging HPââ¬â¢s market position * Creating e- services ecosystems and placing HP at the center 2. Is the proposed merger likely to address these challenges? Benefits from the merger included personal systems, improved economics, and innovation. HP management believed that the combined company would have a lower cost structure due to economies of scale. HP would also be able to leverage Compaqââ¬â¢s progress in developing a direct sales channel, yielding a more flexible distribution model. Complementary leadership in key markets: Compaqââ¬â¢s strength in industry standard servers, coupled with HPââ¬â¢s Linus and UNIX offerings, would result in an industry- leading product line spanning the entire server category. By adding HPââ¬â¢s strength in high- end storage, the combined company would be the industry leader in both the enterprise storage segment and the fastest growing sub-segment storage area networks. Doubling HPââ¬â¢s sales force, the merger would allow HP to increase account coverage and better compete for important customer engagements around the world. IT Services: Strengthened Business Provides Critical Mass in Key Growth Market- Management believed the merger would significantly strengthen HP and Compaqââ¬â¢s combined services business for several reasons. Financial Benefits- As predicted the merger would yield $2.5 billion in annual cost saving by mid-2004. Yes, we do believe the proposed merger is likely to address the challenges HP faces. 3. How do you interpret the marketââ¬â¢s reaction to the proposal deal? We interpret the marketââ¬â¢s reaction to the proposed deal to be negative. Just two months of the Merger announcement, HPââ¬â¢s share price trailed the preannouncement level by 27%, representing a loss of $12.3 billion of market share value at the same time comparable companies increased 9.9%. 4. If you were a shareholder of HP, how would you vote on the deal? If we were shareholders of HP, we would vote against the deal. It is obvious the company is losing a great deal of money at the same time other companies in the same industry are making money. The merger is not looking out for the best interest of the shareholders so we would not vote for the merger. When approaching this one it seemed overwhelming at first. I began pulling outside sources and background information that helped me gain a better understanding of the project at hand. That extra research was very useful in explaining what the companies were going through and giving different perspectives as to why. I was able to apply what I have learned in my accounting classes when the case study and articles referred to financial ratios and provided financial reports. That was helpful when trying to answer the questions assigned. Working with a group was also beneficial because there were several times my group members made great points that I may have missed working alone. Our group has met several times since the project has been assigned. I have been present at each meeting. Before we met the first time we decided we would read the case study in full to have an understanding of what we would need to do. Our first meeting we discussed the case study and our stance on what HP should do. We also discussed the questions within the case study and started our outline for our power point. Outside of the meeting I researched articles to gain background information. Our group had several more meetings at which we outlined our strategy report and assigned each person a portion of the report. When we were finished with our portion we would submit it to the rest of the group for proofreading. Everybody completed their task as set and we came together as a group and finalized the report. I, as well as the other members of the group, contributed to the makeup and layout of both the strategy report and the power point. Charnele Hodge Synopsis Being that this has been my first time in a group doing a strategy report on a company, I took away a few key elements. I have learned, understood, and properly used the purpose of a SWOT Analysis. I know this form of analysis will be used in my future endeavors, so I know it will be very beneficial to me. Also, I learned while in a group setting how to effectively achieve a SWOT Analysis to inform and persuade others to understand and see our point-of-view on our particular position. As a Business Management major, this group project has helped me realize that in not every group setting, that there needs to be a set leader. In my group, I felt that everyone meshed well with each other and there was not a constant need for someone to be in charge. Every group member knew what was at stake and that being at meetings and pulling her part in the group was essential. My individual contribution to the group was making sure that I gave my opinion on the different positions that we would be taking on the SWOT Analysis. I made it my individual objective to make sure that I pulled my part in completing each and every task that I volunteered to work on, that it was done properly, as well as completed on time. Being a Business Management major, I believe I helped bring balance among my other peers that are majoring in different genres in the college of business. I took a more realistic, rational approach to the group, in who would be better fit for particular objectives. I was able to read the Hewlett-Packard and Compaq merger decision and understand the different aspects used to compile the information. In utilizing marketing concepts, I was able to conduct a strengths, weaknesses, opportunities, and threats (SWOT) analysis of Hewlett-Packardââ¬â¢s present company structure. My management background allowed for an understanding of company decisions made, such as whether to undergo a merger. Finally, the accounting knowledge I have acquired thus far has enabled me to read and comprehend the many financial statements used to decide which options should be made based on the factual numbers provided. Overall, my primary takeaway was my ability to read, comprehend, and analyze a case study regarding two merging companies with the knowledge and education provided by Savannah State Universityââ¬â¢s College of Business Administration. Throughout this project I was able to increase my ability to problem solve in a group of my colleagues. No one group is perfect, but the communication skills I have acquired allowed me to handle all situations appropriately and in a timely fashion. For this strategy report, I was responsible for arranging all group meetings regarding the collection and accumulation of information for the paper. I was the initiator of correspondence and also the channel of delivery for every memberââ¬â¢s designated portion of the paper. My personal contribution includes the compilation on the strengths, weaknesses, opportunities, and threats of the present-day company Hewlett-Packard. I was also responsible for the editing of the final paper. Summer Wilcox Synopsis In March 2002, Hewlett- Packardââ¬â¢s current CEO and president, Carleton Firiona announced the acquiring of HPââ¬â¢s rival company, Compaq Computer. The merging of the two companies was designed to put Hewlett- Packard/Compaq in a position to challenge one of its top leaders in the industry, IBM. The merger was also designed to create a global technology powerhouse that would provide consumers with products and services demanded by profitable enterprise customers. After reading over the case, I started to feel like the merger was not going to be a success. The merger presented itself to be too risky. Although Hewlett Packard was aiming to become the industryââ¬â¢s leader by expanding into new markets, the idea of the merger just didnââ¬â¢t seem to look out for the best interest of the company. Management felt that HP and Compaq needed to improve their whole business structure to effectively compete with Dell which was the industryââ¬â¢s leader. They also felt that HP and Compaqââ¬â¢s leadership would complement each other in key markets such as the enterprise storage segment and storage area networks, and by having a broader portfolio of products and services. Management believed that HP and Compaq had a weak combination of products and services, and merging would strengthen that area. While some thought that the merger would be a success to Hewlett- Packard, there were some who were against it. Among those few were the director and son of HP cofounder William Hewlett, Walter Hewlett. Walter Hewlett was HPââ¬â¢s second largest shareholder and had a very powerful, important voting privilege of HP. Walter was against the merger for 4 main reasons. He felt the proposed merger would be worse, the integration risk of the proposed merger would be substantial, the financial impact on HPââ¬â¢s stockholders would remain negative, and the position of the company would not improve. I agree with opposing the merger of HP and Compaq. They knew from the beginning stages that the merger was going to be risky. Shareholders would lose and ample amount of value on their shares. Stockholders would get a very small amount of the combined companyââ¬â¢s contribution to earnings. The merger would drown the stockholderââ¬â¢s interest in the imaging and printing business which is the most profitable of HP already. The merger would not improve the position of the company. Furthermore, HP had no experience with handling a merger of that size. All HP had to do was invest and focus more on the printing and imaging part of the company. The printing and imaging varied in low-end printers and supplies to commercial printing solutions. Instead of taking such a risky acquisition, they could have focused on something that proved already successful for the business. My contribution to the overall strategy report was to research where HP stands now. I also found official documents filed by both HP and Compaq to the SEC about the planned merger. The documents further explained forward- looking statements, assumptions, uncertainties, and risk of the planned merger between the two companies.

At Netflix Hastings was a new man; he changed his use of communications in sending and receiving messages in many ways. At Netflix, Hastings was much more kind and open to new ideas. He changed his way of talking to employees and you can tell by the rise in stock and Hastings being named Businessperson of the year in 2010. 2. He changed his use of feedback by listening to his employees and thier ideas, and when he didnââ¬â¢t understand he would say, ââ¬Å" help me understand your idea, tell me why this will work.â⬠Instead of just rolling his eyes and acting high and mighty like he did and his previous company Pure. 3. Hastings coaching style at Pure was poor; he wanted to change that when he created Netflix. He defiantly improved his coaching guidelines in the following ways; He started giving praise and recognition, not criticizing, and giving specific and descriptive feedback. 4. I feel Hastings used two different styles one at Pure and one at Netflix. I feel the style he used at Pure was more of a Forcing Conflict style. When I read the case I got the impression that Hastings didnââ¬â¢t care what his Pure employees thought about him it was more of a I win you Lose attitude which is what the Forcing Conflict Style is all about. With Netflix on the other hand I feel like he went for more of the Negotiating Conflict Style the more I win some, you win some. He cared more about his employees and how they felt. That is just my opinion but I guess if I had to pick just one style he used in both of them I would pick the Forcing Conflict Style because Hastings still ran a tight ship and at the end of the day he was always going to end up a winner. 5. The Conflictà management style used by Netflix was Collaborating Conflict Style. It is the best solution agreeable to all parties. Joining forces with Epix was a good deal for both of them. Thatââ¬â¢s why I feel the Collaborating Approach was the style used. 6. I am currently a Netflix user; I have been for many years. They are getting better and better every year. I really have no complaints, they have every show that I like to watch, and it is always very quick for me. I think the price is fair, and they let you watch it on every device you own. I as a customer have absolutely no complaints. 7. I think the Group Level of Analysis was used. This level focuses on the relationship between the leaders and the collective group of followers. They focus on how a leader contributes to group effectiveness. Hastings used the Management paradigm by being concerned with stability, and finding out the best way to get the job done. He was able to lead through others, and create favorable conditions for success. He was a very successful leader too; there is no good manager that is not a good leader as well.

Some people prefer eating outside because its easier and more convenient but cooking at home is becoming a hobby for most people. During history nations have created dishes that are special and delicious. Their decedents have learnt these dishes and got so attached to them. This is one big reason why cooking at home wont be a thing of the past. Its exactly like how do people always stick to their lands and they always go back to them no matter how long have they been away, they will always stick to their traditional food and their traditions of cooking at home no matter how much do they eat outside they will always go back to their roots and to the original way of cooking which is at home. For an example, its well known in the Arabic world that the Arabic men will never accept the idea of eating out side the house the whole time and not getting home made food at all. The reason behind this is because all Arabic mothers try to pamper their kids by cooking for them the food at home considering it as the healthiest way and the cleanest way of all. People will always want to eat something they know or to eat something they have cooked even if they are not great cooks but they long for that a lot. The quality of the food greatly affects peoples health. Many people prefer cooking at home because it makes them feel great and have lots of energy. There are few more reasons, why cooking at home has been so important for the health. It helps to have a strong immune system ,so people can stay inà healthy weight and look slim and trim and physically fit. To avoid certain diseases known to be a related to diet and nutrition, particularly cancer, heart disease, stroke, high blood pressure, high cholesterol, diabetes and obesity, we need safe and clean food. Eating a balance of healthy foods that contain carbohydrate, protein, and fat every day will help blood glucose stay in balance. It is also very important to have full knowledge over the quality of food and utensils. All ingredients, while people cooking, should be fresh and utensils should be the best quality. The World Health Organization predicts that depression will be the second highest cause of the global disease problem by 2020. It is clear, that eating fast food thereby increasing stress and tension and reducing joy and liveliness.à It is a fact that eating vegetables, fruits and well cooked fish helps to prevent depression. What humans eat controls the levels of brain chemicals, which regulate behavior (Gutierrez, 2009). Because it is one of the fastest ways to cook, rich of vitamins, such as broccoli and carrots, contain more nutrients, as well as their texture and colour. Also stir-fry recipe requires only two to three tablespoons of oil. This small amount of oil can cook big chicken and any veggies. One of the most popular techniques is boiling. Boiling food involves no fat, so in a sense it is healthy. Therefore, the water that the food is boiled in is actually healthier and it can be used for other purposes, such as using it as stock or for making soup. This water is extremely nutrient rich. Boiling food is a safe way of ensuring that all disease-causing bacteria in the water or the food are destroyed.à Boiling water for a few minutes kills most bacteria, amoeba and other microbial pathogens. It can help prevent illnesses such as cholera, dysentery and other diseases caused by micro-organisms. As for food, boiling makes it is easy to classify. Boiling food on a high flame changes the shape of the food being cooked, while boiling on a low flame helps retain the shape. Some people believe steaming is the best way to go. Steaming preserves the vitamins and minerals in foods. It is also healthy,à becauseà it is does notà requireà any oils or fats. Steam can actually help melt some of the excess fats in foods, which end up in the water that was heated to make the steam. When people using this technique,à it is also less danger of consuming carcinogens that are present in blackened foods. Eating outside is more expensive than eating inside. The cost of the items is different for the same quantity. The statement eating out saves much time and money cannot be convinced (Jeff D Gorman, n.d).à And that makes logical sense; we pay more in fast food restaurants than cooking at home for the same things. People are looking at the quantity. Were spending the same amount of time in both at home and at restaurants. At home, we shop for the ingredients and prepare our food and afterwards we clean the dishes. At restaurants, we either wait for our table to get ready, wait for the food to arrive and afterwards we wait for the restaurant to bring out the check (MetaFilter Network Inc, 1999). In a short term perspective, it may seem that dining out can be cost-effective and convenient. But in a long term perspective, it doesnt matter whether its convenient or not, but itll be very cost-effective (Christian Science Monitor, 2010). Most of the people who cant afford pricey things prefer to eat at home because they know it is cheaper. They wont complain about being mentally tired as long as the saved the money in their wallets. For a restaurant to make profit they need to put all the costs for their expenditure in the meals. They include the rent, employees salaries, and the maintenance bills in the meals. And add a little more to get the profit out of it. Now if someone knew this, how can they explain that its cheaper to eat out when youre paying for things you can do yourself and for things that probably does not concern you, and also for the same amount of time? Buying five pieces of chicken breasts for ten dirhams at a grocery store like Spinneys is much cheaper than ord ering a combo meal of chicken and rice from a fast food outlet for fifteen dirhams. The combo meal will last only for that day while the five pieces for chicken breast will last for three meals if the person is willing to do so. Even if we eat the cheapest food available, such as Chinese takeout, we can feed up to five people with the same amount of money we would spend for the meal to feed ourselves. Even if shopping takes a lot of time comparing when eating at a restaurant, we arent earning or saving any money when we are saving time from shopping. The majority of articles and books and talk about managing your budget when it comes to eating out against eating in would claim that eating out would make your money stretch. Also eating at home would depend all on how you buy your ingredients. It depends on if you buy in a bulk, with coupons, or buying premium meat or standard. It makes logical sense that companies are still selling food ingredients in supermarkets and people are still cooking at home. Dining out is for those going out on a special occasion. One reason to eat outside instead of cooking in the house is because its more convenient and easier to get. specially for that category of people who are lazier and more busy and prefer to not spend their time for cooking and preparing its material as they believe its more time consuming .This category of people believes it is always more convenient to go and get whatever they want and save a lot of time by not cooking. In first sight it may seem that eating outside is more convenient but it is actually more complicated and stressful than it look likes. By considering time people spend standing in the food cues, waiting for their meal and finding an appropriate place to sit and serve their meal will all count part of the time they spend to have a meal outside. In addition, stress and aggressiveness that people may get out of communicating with other people are all part of hassle of eating outside. Greenspan - The Case For The Defence :: essays research papers
My fascination with the Judicial System Structure of today's society was furthered and strengthened after reading and analyzing the works of Edward Greenspan.This superbly written biography recollecting past cases and important events in Greenspan's life allowed myself, the reader, to learn more about Jurisprudence and the Criminal Code. The entire casebook revolves around several main themes including the balance of Positive & Natural influences in the courtroom, whether a lawyer's consience intervenes with his duty as a counsellor, and the alarming rate of perjury occuring in front of the juries. To be more concise and clear to the point, Greenspan's book is a diary of controversial and beneficial issues which have hovered around our criminal courts and will continue to plague and pester them for years to come. By observing and understanding certain issues presented in his book, I was able to comprehend what type of person Greenspan is, what he believes in, what he represents and what he would do for his profession.The wheels of Jurisprudence are always turning, and I came to realise how Greenspan worked and bargained for his status in the country to be solidified. This book also flourished with innovative situations pertaining to the most diversified of criminal charges, to the most uncanny regions of law ever dealt. It was this thorough look at Greenspan's life which impressed this reviewer the most.It was quite clear that after the fourth page, I came upon the conclusion that this casebook would create a most influential reaction to anyone who had displayed any interest towards our Law system in general. Part One of the novel, No Little Clients, presents the reader with the author's proposed thesis. His ambition is to defend innocent people accused of crimes. Whether they are innocent or guilty without being proven guilty is irrelevant to Mr. Greenspan. A lawyer's consience must not be his deciding factor when advising or counselling a client. This viewpoint is elaborated in Part Two (Not Above The Fray) and explained frivolously by Greenspan himself. Throughout the entire novel, the theme bends and curves itself around different and unavoidable situations, but retains its original meaning that no one is guilty until proven so. Greenspan refers to this phrase countless times and explains to the reader that he will not allow his moral beliefs to conlfict with the path of justice (delicately and persuasively explained by both Greenspand and the co-author, George Jonas in Parts Four, Five and Six of the novel). Progressive America? The early 1900ââ¬â¢s can also be referred as the progressive movement because of the many reforms and improvements that occurred during the era. 2005 is much like the earlier progressive movements and can be classified as a progressive era. 3 out of the 4 goals of progressivism are being practiced during the 21st century. Social welfare, economic reform, and moral improvements are still being practiced to try to improve the quality and fairness of life in the U.S. Social welfare improvements are occurring right now to try and better our country as a whole. Bushââ¬â¢s new plan calls for standardized testing and education reforms to try and improve literacy in the U.S. much like during the 1900ââ¬â¢s when womanââ¬â¢s groups were fighting for better education standards in schools. In fact standardized testing was first suggested in the early 1900ââ¬â¢s to try and improve schools. Many in the 1900ââ¬â¢s were advocates for child protection such as Florence Kelly who helped establish child labor laws and set up schools. In the progressive period we first saw the salvation army and attempts to try and improve living conditions for many Americans, groups like the YMCA help build safe communities to keep kids out of trouble. In 2005 Bush recently tried to improve poverty by modernizing social security to keep retirees from going broke. Bush also plans to update Medicare provide tax relief to those who need it. Just like in the early 1900 ââ¬â¢s aid groups are on the rise and have broadened there boundaries to help more people (doctors without borders, red cross, operation smile). During the era we witnessed a climb in the birth of many of these groups but in 2005 we are seeing a rapid increase in the number of non-profit organizations much like those simpler ones we saw in the past. The need to keep children safe has also sprung to life again as it did in the progressive era the need for children to ââ¬Å"stay of the streetsâ⬠as fueled many people to open/found teen centers and other hangouts where kids can be under adult supervision. Economic reform was and is very important to the survival of this country during the progressive period and directly indicates that 2005 is a progressive era. During the progressive era economic improvements was basically just revealing corrupt companies and trying to give the workers more rights and powers.

Health Education and Technology Essay
According to Bastable, ââ¬Å"Technology has had such an impact on workforce training that it has given birth to a new industry and a new set of buzz words that define an Information Age approach to staff education. â⬠(2007, p. 548) Thus, the inclusion of technology early on, as in its integration to education, has been deemed necessary. However, due to the evolution of technology, curriculum design and implementation in the field of health education will undergo a series of changes and modifications. These various changes will be determined based on the outcomes of technological evolution, the perceived potential of technology to change the landscape of health education in the future, and the educational theories, principles, approaches, etc. developed by respected members of the academic institution through research studies. According to Iwasiw, Goldenberg, and Andusyszyn, ââ¬Å"Curricuralists should gather data about technology and informatics for health care and education, as well as expected developmentsâ⬠(2008, p. 13) Based on pertinent information gathered by academicians, the focal point and foundations of curriculum design are expected to change. Apart from the traditional contents of the curriculum, the scope of curriculum design should be broadened in order to include the ââ¬Å"e-health paradigm of heath careâ⬠(Iwasiw, Goldenberg, & Andrusyszyn, 2008, p. 113), literacy in information technology, health education across disciplines, and health education in the changing world. In addition, due to the impact and contributions of technology to the field of health, allowing the course nursing informatics to become compulsory will help in opening up opportunities for the improvement of curriculum design through the undeviating inclusion of technology and informatics. When we think about it, making nursing informatics compulsory makes the course an important learning area or aspect of health education. Consequently, much needed attention will be diverted to the improvement of the course by making course objectives, contents, instructional processes, and so on, up-to-date. Thus, the quality of health education, due to its appropriateness with current technology, will also improve. Just as curriculum design changes due to the evolution of technology, the implementation of the curriculum during instruction is also expected to change. As Bradshaw and Lowenstein (2006) have discussed, the delivery of the curriculum as influenced not only by traditional concepts in education but also by technology ââ¬Å"require organized and planned educational experiences that are guided to promote lifelong learning as well as individually motivational and experiential learning activities that involve a variety of experiential teaching methodsâ⬠(p. 272). Due to the inclusion of technology in the curriculum, the process of instruction will become more complex such that the assessment of the students and the selection of instructional tools, methods, and approaches are not merely based on student interests, learning capacities, learning content, etc. but also on the kinds of technology that fits the curriculum content. (Bradshaw & Lowenstein, 2006) In terms of the instruction, the instructional process is facilitated by the use of technology. However, when it comes to learning content, the integration of technological concepts become necessary. In addition, the scope of learning content also varies from time to time since available technological tools and devices intended to facilitate heath education and health care processes change over time. For these reasons, diversity and variation should be accepted and acknowledged by academic institutions since the curriculum design and the implementation of the curriculum shall change along with the evolution of technology along the way.

Earvin ââ¬Å"Magicâ⬠Johnson is not only amongst the all-time greatest basketball players, but he is also a well-respected philanthropist. Magic Johnsonââ¬â¢s glorious basketball career began as a student at the Michigan State University. He led the team to a National Championship title in 1979. Johnsonââ¬â¢s skill qualified him to play at the National Basketball Association (NBA). While playing with the Lakers, the team won five NBA championships and participated in nine NBA finals. He was honored by being named the NBA Most Valuable Player three times. Johnson also played on the U. S. A. Olympic team that won the gold medal in the year 1992. In 2002, he was inducted into the Basketball Hall of Fame. He was particularly known for his excellent passing skills. On October 25, 1991, his doctors told Johnson that he had the HIV virus. Says Johnson, ââ¬Å"That was the hardest day of my life. After I got myself off the ground, I decided to have a positive attitude (NBA Legend).â⬠Two weeks later, on November 7, 1991, Johnson announced to the world at a press conference organized by the Lakers about his affliction. At the conference, he said that he would not give up to the disease easily and would battle it. He announced that he would become a spokesman about HIV. As the doctors had advised him not to play basketball any longer, Johnson announced his retirement from basketball. Johnson decided that he would use his fame and his status as an icon for millions of people to educate the youth about HIV. One month after his diagnosis, he started the Magic Johnson Foundation. According to a research conducted by Pollock (426), the revelation of Magic Johnson had changed the attitude of people about AIDS and influenced them to alter their behavior in order to avoid the virus. The foundation has raised millions of dollars to build four modern clinics for people afflicted with AIDS. Free HIV/AIDS testing has been provided to approximately 38,000 people across America through the ââ¬Å"I Stand with Magicâ⬠program. The foundation has helped nearly 280,000 people understand the risk factors of contacting HIV. The foundation also provides educational and medical help to children and young adults. The foundation has opened 20 Community Empowerment Centers in underserved communities (Magic Johnson Foundations). When Hurricane Katrina occurred, the foundation partnered with various grocery and drugstores, provided prescriptions and groceries to victims. The renowned basketball player also stated that he would find ways to generate jobs to those who have been displaced by Katrina (Tucker 1). Magic Johnson received the USA Todayââ¬â¢s National Hero Award for his contribution to the society through the Magic Johnson Foundation. Magic Johnson is also an active businessman. He runs a company called Magic Johnson Enterprises (MJE). MJE has several businesses in its portfolio, which include Canyon-Johnson Urban Fund, SodexhoMagic, Aetna, and BestBuy, 30 Burger King restaurants, Magic Johnson Theaters, and a dozen sports centers. The company aims to provide products and services to ethnically diverse communities and minorities (Earvin ââ¬Å"Magicâ⬠Johnson Biography). Even after 17 years of being diagnosed with HIV, he has not developed AIDS. Magic Johnson can be called a self-made success story and a great sportsman and social worker who has selflessly used his iconic status to help countless people lead a better life.
